These terms are the agreement between you and Vivier Health & Longevity, LLC, a New Jersey limited liability company. They apply when you use this website, submit the waitlist form, hold a membership, or receive care from us.
Using the site means you accept them. If you do not, please do not use it.
This website is not medical advice
Everything published here — the guides, the therapy descriptions, the FAQ — is general education. It is not medical advice, diagnosis, or treatment, it is not tailored to you, and reading it does not create a physician–patient relationship between you and any clinician at this practice.
That relationship begins when you are accepted as a patient, have been clinically evaluated, and a clinician has agreed to treat you. Not before, and not by virtue of an inquiry.
No outcome is promised or implied. Individual results vary. Several therapies described on this site are prescription-only, compounded, or investigational, and are not approved by the FDA for the uses discussed; whether any of them is appropriate for you is a clinical judgment made after evaluation, and the answer is sometimes no.
Never disregard advice from your own clinician, or delay seeking it, because of something you read here.
Emergencies
This website, the patient portal, and secure messaging are not emergency services and are not monitored continuously. If you believe you are having a medical emergency, call 911 or go to your nearest emergency department. If you are in crisis, call or text 988 to reach the Suicide & Crisis Lifeline.
Who can use this site and become a patient
- You must be 18 or older to use this site or to become a patient.
- You must be physically located in a state where our clinicians are licensed at the time of a visit. This is a legal requirement of medical practice, not a preference, and it applies to remote visits as much as in-person ones.
- You must give us accurate information, including your identity, your medical history, and your current medications. Care is only as safe as what it is based on.
We may decline to accept anyone as a patient, and a clinician may decline to provide a particular therapy where it is not clinically appropriate. Membership does not entitle you to a specific treatment.
The waitlist
Submitting the waitlist form is an expression of interest. It is not an application, it does not create a membership, it does not reserve a place, and it does not oblige either of us to anything. We will contact you to discuss whether the practice is a fit.
What the form collects and how it is handled is described in our privacy policy.
Membership and fees
Membership is a subscription. The tier you choose, its price, and what it includes are set out at the time you enrol, and that description is part of this agreement.
Billing
- Fees are charged in advance for each billing period to the payment method you provide.
- Membership renews automatically at the end of each period, at the then-current price, until you cancel. You are authorizing a recurring charge.
- Payments are processed by Stripe. Card details go to Stripe and are not held by us. Stripe's terms apply to that processing.
- If a payment fails we will attempt it again and tell you. Membership may be suspended while an account is unpaid.
Price changes
We may change membership prices. Any change takes effect at your next renewal, and we will tell you at least 30 days beforehand so you can cancel first if you would rather not continue.
What membership is not
Membership is not health insurance and is not a substitute for it. It does not cover hospital care, emergency care, or services from other providers. We are not an insurer and we do not accept insurance for membership. Some services may be billed separately from the membership fee, and we will tell you before that happens.
Cancellation and refunds
You can cancel at any time by writing to support@vivierhealth.com or through your account. Cancellation takes effect at the end of the billing period you have already paid for — your membership continues until then, and you are not charged again.
Fees already paid are not refunded on a pro-rata basis unless we say otherwise in writing or the law requires it. Where a service has been paid for and not yet provided, we will refund it.
We may suspend or end a membership for non-payment, for a serious or repeated breach of these terms, or where the clinical relationship has broken down. Except where conduct makes it impossible, we will give reasonable notice, help you arrange continuing care elsewhere, and refund any period you have paid for and will not receive. Ending a membership never affects your right to a copy of your medical record.
Telehealth
Some care may be delivered remotely. Before your first remote visit you will be asked to consent to it separately, and that consent — not this section — sets out what telehealth involves and its limits.
In short: the clinician and the standard of care are the same, but a remote visit cannot include a physical examination and some things can only be assessed in person. Your clinician may ask you to be seen in person, to seek local care, or to go to an emergency department. That judgment is part of good care. Consent to telehealth is voluntary and you may withdraw it without affecting your membership.
Your account
You are responsible for keeping your sign-in credentials confidential and for what happens under your account. Tell us immediately at support@vivierhealth.com if you think someone else has access to it.
Do not share an account. A shared account makes the audit trail — the record of who accessed which health information, which we are legally required to keep — inaccurate for everyone on it.
Acceptable use
Do not:
- Attempt to access an account, record, or system you are not authorized to reach, or probe, scan, or test our security without our written permission
- Interfere with the site's operation, or submit automated or bulk traffic to it, including to the waitlist form
- Upload malicious code, or anything unlawful, abusive, or infringing
- Copy, scrape, or republish the site's content other than as described under intellectual property
- Impersonate anyone, or misrepresent your identity or medical history
- Use anything here to provide medical advice to someone else
If you believe you have found a security vulnerability, please tell us at support@vivierhealth.com rather than demonstrating it. We will not pursue anyone who reports a genuine issue in good faith and gives us a reasonable chance to fix it.
Intellectual property
The content of this site — text, design, photography, video, and the patient guides — belongs to Vivier or is used with permission, and is protected by copyright and trademark law. The Vivier name and wordmark are ours.
You may read the site, and download or print a guide for your own personal, non-commercial use. Anything beyond that needs our written permission.
Third-party services and links
The site links to and relies on services we do not control — our payment processor, mapping, and others' websites. We are not responsible for their content, availability, or practices, and their own terms and privacy policies apply to your use of them.
Availability and accuracy
We aim to keep this site available and current, but we do not guarantee either. It may be unavailable for maintenance or for reasons outside our control, and content may become out of date. To the fullest extent the law allows, the site is provided “as is” and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
This disclaimer is about the website. It says nothing about the standard of clinical care you receive, which is governed by the law of medical practice — see below.
Limitation of liability
This section limits our liability for the website. It does not limit — and nothing in these terms limits — our liability for the clinical care we provide, for death or personal injury caused by negligence, for fraud, or for anything else the law does not permit to be limited. A medical practice cannot contract out of professional responsibility, and this one is not attempting to.
Subject to that, and to the fullest extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of this website; and our total liability arising from your use of the website is limited to the membership fees you paid us in the twelve months before the claim arose.
Some states do not allow certain limitations, in which case they do not apply to you.
Indemnification
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your violation of someone else's rights. This does not apply to any claim arising from the care we provide or from our own negligence.
Governing law and disputes
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.
Any dispute arising from these terms or from your use of this website will be brought in the state or federal courts located in Bergen County, New Jersey, and we each consent to the jurisdiction of those courts.
Claims relating to clinical care are excluded from this section. They are governed by New Jersey law on medical malpractice and by any separate agreement you have signed about them, and nothing here shortens a limitation period, waives a right to a jury, or requires you to arbitrate such a claim.
Before starting a formal dispute of any kind, please contact us at support@vivierhealth.com. Most things are resolved that way.
Changes to these terms
We may revise these terms. The effective date at the top changes when we do, and the revised terms apply from that date. If a change materially affects your membership, we will tell you at least 30 days in advance, and you may cancel before it takes effect. Continuing to use the site or your membership after that date means you accept the revised terms.
General
- Severability. If a provision is held unenforceable, the rest stays in force and that provision is narrowed to the minimum extent necessary.
- No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.
- Assignment. You may not transfer your rights under these terms. We may assign ours to a successor of the practice, on notice to you.
- Entire agreement. These terms, our privacy policy, our Notice of Privacy Practices, and the consents you sign as a patient are the whole agreement between us. Where a signed clinical consent conflicts with these terms, the clinical consent governs.
- Survival. The sections on intellectual property, liability, indemnification, and disputes survive the end of your membership.
